Tucker and the Collateral Source Rule - In 2010 the Colorado Supreme Court addressed the "billed v. paid" issue in personal injury cases. The fight was whether a tort plaintiff is entitled to recover the full amount billed for medical treatment, or whether recovery is limited to the discounted amounts actually paid by an insurer in full satisfaction of billed amounts. Tucker, 242 P.3d 1080 (Colo. 2010), clearly favors the plaintiff. Defendants are not entitled to a post-verdict setoff of the difference between the billed and paid amounts.
